Brainscanology Terms of Service

Introduction:
These terms and conditions govern the use of our online subscription service (the "Service"). By using the Service, you agree to be bound by these terms and conditions and are attesting to your compliance thereto. If you do not agree to these terms, do not use the Service.

Service Provider:
Brainscanology’s Services are provided by, and you’re contracting with:

Age Requirement:
You must be over the age of 18 to use Services.

Basic Account (Free):
The Basic Account is free of charge and is best for curious Evaluators. It provides access to 50 MB of storage for input files and 10 MB of storage for output files, with a status bar showing usage of each storage quota. The Basic Account also has a monthly analysis limit of 250 images, with a status bar and file count showing usage of the monthly analysis quota. The monthly analysis limit is calculated every 30 days starting from the day the account is created.

Clock Draw Test:
BrainScanology now offers at-home objective Clock Draw Test (CDT) for tracking cognitive decline and early dementia. It's like checking your blood pressure, except once per month. CDT Open is a FREE monthly clock draw analysis! All you need is pen, paper, and smartphone camera. Our revolutionary technology tracks subtle but significant changes in peoples’ hand-drawn clocks over time that are hidden to AI and the naked eye. With just one monthly upload, this powerful cognitive assessment aid is the perfect addition to your early detection tool kit. Disclaimer: CDT cannot and does not diagnose dementia. Many health conditions unrelated to dementia can affect a person’s ability to draw a clock normally. Therefore, any results of a CDT (positive or negative) should be discussed with a licensed professional before jumping to any conclusions.

Handwriting Test:
BrainScanology now offers at-home objective handwriting test for tracking neurological tremor based on the handwriting of numerical integers ranging from 1 to 12. Users who subscribe to “CDT OpenMax” can submit one handwriting analysis worksheet every 30 days. The handwriting analysis results may objectively show quantitative differences in the shape of handwritten numbers that could be due to the onset of tremors or hand injuries.

Disclaimer:
While the handwriting analysis provides evidence indicating symptoms of neurological damage, it cannot and does not diagnose Parkinson’s Disease or any neurological disease. Many health conditions unrelated to Parkinson’s Disease can affect a person’s ability to write numbers consistently. Therefore, any results of a handwriting analysis should be discussed with a licensed professional before jumping to any conclusions.
 
Compliance:
The Service complies with HIPAA and other medical scanning industry-specific regulations.

Changes to Terms and Conditions:
These terms and conditions may be updated from time to time, and you will receive appropriate notice. The current version of these terms and conditions can be found on our website.

Global Users:
The Service has users worldwide, and we comply with the necessary data and privacy standards of different regions and countries.

User Code of Conduct:
Users of the Service are expected to conduct themselves in a manner that is respectful of others and in accordance with the law and may be removed or banned from use at the sole and absolute discretion of the Company.

For all users:
Both the law and these terms try to strike a balance as to what you or Brainscanology can claim from the other in case of problems. That’s why the law allows us to limit certain liabilities — but not others — under these terms. These terms only limit our responsibilities as allowed by applicable law. These terms don’t limit liability for gross negligence or willful misconduct.

To the extent allowed by applicable law:

  • Brainscanology is liable only for its breaches of these terms or applicable service-specific additional terms

  • Brainscanology isn’t liable for:

    • loss of profits, revenues, business opportunities, goodwill, or anticipated savings

    • indirect or consequential losses

    • punitive damages


Brainscanology’s total liability arising out of or relating to these terms is limited to the greater of (1) \$200 or (2) the fees paid to use the relevant services in the 12 months before the dispute For business users and organizations only.

If you’re a business user or organization:
To the extent allowed by applicable law, you’ll indemnify Brainscanology and its directors, officers, employees, and contractors for any third-party legal proceedings (including actions by government authorities) arising out of or relating to your unlawful use of the services or violation of these terms or service-specific additional terms. This indemnity covers any liability or expense arising from claims, losses, damages, judgments, fines, litigation costs, and legal fees.

 

If you’re legally exempt from certain responsibilities, including indemnification, then those responsibilities don’t apply to you under these terms. For example, the United Nations enjoys certain immunities from legal obligations and these terms don’t override those immunities.

Governing Law:
These terms and conditions are governed by the laws of the state of Delaware.

Entire Agreement
These terms and conditions constitute the entire agreement between you and us regarding the use of the Service.
